A United States judge has rejected billionaire Australian mining magnate Andrew Forrest's attempt to sue Facebook ads that used his image to promote fake crypto schemes. Meta Platform argued this based on Section 230 of the Communications Decency Act, which denies its liability as a third-party content publisher. But Judge Casey Pitts noted that Meta had not "unequivocally proven" that Section 230 provides a "conclusive defense" to all of Forrest's claims.

Judge Pitts allowed Forrest to reopen the case and attempt to prove that Meta's negligence in stopping fraudulent advertising violated its duty to operate in a "commercially reasonable manner." Forrest claimed that Meta played an "active role" in how their names appeared and to whom they were shown.
