According to reports, the Supreme Court currently has 9 justices, of which 6 are conservatives, and the other 3 are liberals. Three of the conservatives were nominated by Trump during his presidency. The Supreme Court passed the ruling with 6 votes in favor and 3 votes against.

According to Reuters, Chief Justice Roberts, writing for the majority, said that the president "is not above the law," but he cannot be prosecuted when exercising core constitutional powers, and his "official actions" should enjoy presumed immunity, while his "private actions" do not enjoy immunity.

Liberal Justice Sotomayor, who dissented, said that according to the ruling, the president "is above the law like a king when exercising official power." Justice Jackson said, "For the first time in history, the (U.S.) court has declared that the most powerful official in the United States can be a law unto himself (when the situation is not yet fully determined)."

The U.S. Supreme Court sent the case back to a lower court to determine which of Trump's actions were "official conduct" that could not be prosecuted.

According to previous reports, on January 6, 2021, while Congress was counting the electoral votes for the presidential election, a large number of Trump supporters violently stormed Congress, resulting in at least 5 deaths. In August 2023, Smith, a special prosecutor of the U.S. Department of Justice, filed four charges against Trump for his connection with the "Capitol Hill Riots." Trump has been asking the court to dismiss the case on the grounds that he enjoys presidential immunity. Both the Washington District Court and the Federal Circuit Court of Appeals made rulings against Trump. In February 2024, Trump appealed to the Supreme Court.

On the same day, a spokesperson for the White House Counsel's Office said in a statement, "As President Biden said, no one is above the law. This is a core principle and the way our judicial system works. We need leaders like President Biden who respect the judiciary and will not undermine the judicial system."

The Biden campaign issued a statement saying that the Supreme Court's ruling "cannot change the facts of the Capitol Hill riots on January 6, 2021." The team said, "After Trump lost the 2020 election
