Terraform Labs Co-Founder Do Kwon's Extradition Decision Rests With Montenegro's Justice Minister
According to U.Today, the ongoing legal battle involving Do Kwon, co-founder of Terraform Labs, has taken a new turn. The Montenegrin High Court has approved Kwon's extradition for the second time, leaving the final decision to the Minister of Justice, Andrej Milovic. The High Court had previously ruled in November that Kwon met the legal requirements for extradition requests from South Korea and the United States. However, the local Supreme Court overturned this decision, necessitating a reevaluation by the High Court and a restart of the extradition process.
The Supreme Court clarified in its ruling that the court's role is to determine if the defendant meets the requirements for extradition. The decision to approve or prioritize extradition should be made by the competent minister, not the court. Kwon and his attorney have three days from the date they receive the translated ruling from the High Court to file an appeal. It is currently unknown whether Kwon will choose to appeal. There is speculation that he may be extradited to the United States, as Minister Milovic has indicated a preference for this outcome.
Kwon's legal troubles began following the crash of the stablecoin TerraUSD and cryptocurrency LUNA. He fled to Montenegro via the United Arab Emirates and Serbia, where he was arrested for using a fake passport. After serving a sentence, he was moved to a detention center to await the extradition decision. As previously reported, Kwon could face up to 40 years in prison due to his involvement in the Terra LUNA Coin incident and the $40 billion TerraUSD collapse.
