Virtual Currencies as a Type of Report able Account: On December 31, 2020, FinCEN issued a notice stating that it intends to amend regulations implementing the Bank Secrecy Act to include virtual currencies as a type of report able account for the requirement to file a Report of Foreign Bank and Financial Accounts.

  1. Border Restrictions and Declaration: Some U.S. lawmakers have proposed a requirement that individuals declare their cryptocurrency holdings when entering the U.S. However, to date, no such requirement has gone into effect.

  1. Amendments to Existing Laws: The White House is considering calling upon Congress to amend the Bank Secrecy Act, anti-tip-off statutes, and laws against unlicensed money transmitting to apply explicitly to digital asset service providers, including digital asset exchanges.

  1. Regulatory Assessments: The U.S. Treasury is set to complete an illicit finance risk assessment on decentralized finance by the end of February 2023 and an assessment on non-fungible tokens by July 2023.

These regulations aim to mitigate risks associated with cryptocurrency transactions, such as money laundering and fraud, and ensure compliance with existing financial laws.
