$LUNC Lawyers for Terraform Labs co-founder Do Kwon have asked a US federal court to reject the US Securities and Exchange Commission's (SEC) request to question him in the US about the collapse of the Terra ecosystem.

In a document dated Sept. 27, Kwon's legal team said the SEC's request to question him in the U.S. before Oct. 13 was "unfeasible" due to his detention in Montenegro, "with no release date or extradition scheduled .”

Furthermore, Kwon's team said that providing written testimony to the SEC's inquiries would be inconsistent with their client's rights in the proceeding under U.S. law.

“An order that dictates something that is impossible serves no practical purpose and risks undermining judicial authority.” Notably, Kwon's lawyers claim that Kwon did not directly object to giving testimony, but noted that it would need to take place in Montenegro , where Terra's founder is currently on parole.

According to the filing, the deadline for Kwon to testify as part of the SEC's case against him and Terraform Labs is October 13.

Kwon's legal team added that a Montenegrin court has "informally" indicated that it may still hold a hearing on October 13 or 26, in which it would ask Kwon the questions referred by the SEC. However, the SEC noted that it considers such a procedure “inappropriate” and wants to schedule a new date for Kwon's testimony after the current deadline.

The SEC filed suit against Terraform Labs and Kwon on Feb. 16 for having “orchestrated a multibillion-dollar cryptocurrency securities fraud.” Losing was never an option.”
