Babbitt News: China Prosecutorâs WeChat official account recently published an article titled âCriminal Prosecution | Identification of the Nature of Illegal Acquisition of Virtual Currency in the Perspective of the Unity of Legal Orderâ. The article points out that virtual currency, as a special kind of virtual property, meets the characteristics of âpropertyâ and should be evaluated as the object of property crime in the criminal law. The state has adopted a stricter control policy on virtual currency-related business activities, denying the âcurrencyâ attribute of virtual currency, but has never denied the âpropertyâ attribute of virtual currency. The judgment and identification standards of the effectiveness of civil legal acts have no theoretical connection with the judgment and identification standards of the protection of âpropertyâ in the criminal law. The validity of virtual currency contracts cannot be used as a basis for denying the âpropertyâ attribute of virtual currency in the criminal law. Affirming the âpropertyâ attribute of virtual currency in the criminal field does not violate the unity of legal order.
