According to Blockworks, Consensys’ lawsuit against the U.S. Securities and Exchange Commission (SEC) and its chairman Gary Gensler was dismissed in a Texas court. The lawsuit was filed in April this year, accusing the SEC of investigating Ethereum and issuing a Wells notice to the company behind MetaMask.

The SEC said in an April notice that it planned to file a lawsuit against Consensys, alleging that its MetaMask Swaps and MetaMask Staking products violated federal securities laws. Nonetheless, the SEC has filed its own lawsuit against Consensys since April, alleging that Lido and Rocket Pool are unregistered securities.

In dismissing the lawsuit, Judge Reed O’Connor noted that these enforcement actions do not constitute final agency actions and the notices do not establish the plaintiffs’ legal rights or obligations. Consensys’s allegations against ETH were also dismissed because the SEC had earlier announced that it had abandoned its investigation into ETH.
