Avraham Eisenberg, who was previously found guilty, applied for a not guilty verdict and a retrial this week, Blockworks reported. Judge Arun Subramanian approved the application, allowing his legal team to move forward. The 77-page document stated that the original trial was improperly conducted in the Southern District of New York because there was no evidence that the crime occurred in the district. The lawyer said Eisenberg was in Puerto Rico at the time and was more relevant to the case. He was arrested in Puerto Rico on suspicion of fleeing, but his legal team said he fled because he received threats. Eisenberg was convicted of three counts: commodities fraud, wire fraud, and commodities manipulation.
