After the government responded to Storm's motion to dismiss the trial, the defense team filed another reply, arguing that the case against him should be dismissed on the grounds that the government did not take sufficient steps to prove that Storm actively participated in the crimes alleged in the indictment. They questioned the government's description of Tornado Cash as a "money transfer business," a claim that even attracted the attention of Senators Ron Wyden and Cynthia Lummis. Storm's lawyers argued that characterizing Tornado Cash as a money transmission institution "violates due process, leniency, and principles against innovative structures."
