Why is this uncle not helping me this time!!? So frustrating, do I only have the option to accept the punishment!!
Today a new friend who just joined ⭕ not long ago asked me, looking for a (seller), transferred 20 to (the seller), but didn't get U, was scammed; can this be recovered?
The situation is like this, siblings analyze, can we recover through the uncle?
My friend said that because he had traded with him before, it was normal to give me U, so he trusted this seller quite a lot, named A. Normally buying from A would just be about a five-cent markup. Recently, when my friend sought to purchase, A said to first give him the money, let him collect it offline, making it cheaper.
Then after my friend transferred the money to A, A said he was scammed, trading offline with others, and A took cash to find someone else to exchange it for AU, but U gave it to someone else.
We can clearly analyze that this is a civil dispute.
For this kind of incident, we just need to find A's ID, and then at the residence of the other party's ID or find A's place of residence. Of course, this case will most likely only be handled by a lawyer, and when we are in this situation, many times the court window will not accept it; reporting to the uncle is the same, there is nothing that can be done. We can only resolve it through litigation.
When you transferred money and did not receive the coins, the only fault of A was not transferring U as agreed. This falls under a breach of contract in the sale of goods, constituting a contractual dispute.
It's like I transferred you some money to buy a batch of iPhones, and you tell me that during the transportation process, the iPhones were stolen, robbed, or scammed; it's not related to me, and you did not fulfill your contractual obligations, then I just need to file my claim through litigation.
My analysis is: because this is not a criminal case, will reporting to the uncle be accepted? Then this can only be pursued in court. Because Bitcoin is still quite special in the country, the situation is more complicated. It is equivalent to not being able to determine its legality; if not handled properly, 20 are just gone.
Unless there is evidence proving he was trying to scam you while selling you the coins, but you can't possibly have that evidence. Moreover, it is highly likely that A might really be in the situation he described, having transferred the money to him, and what situation A encountered during the cash income process ultimately led to A not being able to give you the coins as agreed; that is a civil dispute.
If this behavior itself is a civil dispute, it can only be resolved through civil litigation by filing a case in court. However, because many case acceptance windows may be unwilling to accept cases involving virtual currency, this is indeed a situation that involves different courts' understanding of virtual currency.
What is the likelihood of recovering this?
So can we recover through litigation? First, can this lawsuit be won? The second aspect is whether it can be executed.
Winning a lawsuit involves two points: whether the case will be accepted, whether the case will support your request to recover 💰💰, and the third is whether it can be executed.
The first acceptance, based on the number of cases handled by the court, this case should be accepted.
The second judgment can be won as long as the evidence is conclusive, with corresponding transfer proof (bank card records) and chat records; this case is likely to be won.
The third question is whether the execution can be carried out effectively, that is, whether the money can be recovered; this aspect is hard to say.
Why? We are not clear if A has money; assuming he is a deadbeat, if A just doesn't want to pay back, then this matter becomes troublesome. A was detained for thirty-seven days because of that money; it was the court that sentenced A for illegal operation. If considering to pursue further, it would involve other matters irrelevant to us because you, as a cryptocurrency buyer, have nothing to do with A's illegal activities. Our funds are likely to just come to nothing.
This wave directly cleans out what was previously 🧱!
CC can only say this friend is quite bold... I advise all newcomers or siblings trading cryptocurrencies, really do not try to take small advantages. Isn’t there a saying, 'Everything obtained has a price set by fate in the dark'?
