According to Foresight News, Bitcoin miner Greenidge Generation has filed a lawsuit against the New York State Environmental Protection Agency (DEC) over the rejection of its application for renewal of the Dresden power plant's Category 5 air permit, after DEC rejected the application in June 2022 for not complying with the Climate Leadership and Community Protection Act. Greenidge said it would be forced to close and cease operations at the facility by September 9 if DEC's decision is not reversed.

Greenidge called the DEC's decision "arbitrary and capricious" and an interference with the New York State Public Service Commission's jurisdiction over power generation facilities. The company noted that the regulator's closure decision was based on its involvement in cryptocurrency mining, even though the facility also provides electricity to the grid. Greenidge also highlighted the facility's contribution to the state's economy, including jobs and tax revenue.
