The lawsuit has been going on for more than a year, and O'Neal is listed as a defendant, claiming that the NFT is an unregistered security. Recently, Miami Federal Court Judge Federico Moreno ruled on O'Neal's motion to dismiss, holding that the plaintiff's accusation that O'Neal was the "seller" of the Astrals NFT project meant that O'Neal needed to respond to it. However, the judge rejected the claim that O'Neal was the person controlling the project. The May 2023 lawsuit stated that the NFT was an unregistered security promoted online by O'Neal.
