Can Binance claim for Terra Lunc and USTC on behalf of users?
The collapse of Terra Luna 1.0 and the decoupling of UST in 2022 caused huge losses to many Binance users. It is strongly recommended that Binance, as a platform, file a claim application with Terra on behalf of users, because the priority of collective claims should be higher than that of retail investors, and the right to speak should be greater. It is recommended that Binance assume the due responsibilities of the platform. Binance must have historical snapshots of the losses of user assets before and after the collapse, and it will be more direct to calculate the claims losses later.
The following is an excerpt from the claim notice initiated by the Terra project:
On June 30, 2024, the debtor filed a Chapter 11 liquidation plan for Terraform Labs Pte., Ltd. and Terraform Labs Limited [File No. 416] (the "Plan"). Among other things, the Plan provides a mechanism for cryptocurrency loss claim holders to make distributions.
August 21, 2024 at 5:00 p.m. (ET) will be the deadline for each person or entity (including individuals, partnerships, corporations, joint ventures, trusts, and governmental units) to submit a proof of claim for cryptocurrency losses incurred prior to the applicable filing date.
“Cryptocurrency Loss Claim”3 means any claim arising out of or related to Digital Assets, including, without limitation, any claim arising out of or related to the purchase, sale or cancellation of the purchase or sale of Digital Assets issued, created, generated, minted, promoted, or otherwise associated with the Debtors and their Affiliates and any decentralized or centralized applications or protocols on the TerraLuna Classic and TerraLuna blockchains (such digital assets, “Terra Crypto”), any wrapped or bridged versions of Terra Crypto on any blockchain, any Terra Crypto staked or bonded on any blockchain, any centralized or decentralized liquidity, lending or borrowing application or protocol on Terra Crypto on any blockchain, any receipt or derivative of Terra Crypto on any blockchain, any derivative transaction or perpetual swap on Terra Crypto, or any other digital asset derived from Terra Crypto, and any other digital asset traded or offered on the TerraLuna Classic and TerraLuna blockchains.
