According to the indictment, Mobile World Joint Stock Company (headquartered at 128 Tran Quang Khai, Tan Dinh Ward, District 1, Ho Chi Minh City) signed a labor contract with Nguyen Anh Dung on September 1, 2021, assigned him to work at the store 21D Hang Bai, Hoan Kiem District, Hanoi. During work, Dung was given an identification code to log into the company system.

From the beginning of April 2023, Dung started participating in virtual currency games and suffered losses, thereby giving rise to the intention of appropriating the company's assets.

Dung deceived Mr. Nguyen Van Kien (assistant store manager at 21D Hang Bai) that there were regular customers who wanted to buy a large number of phones outside the system, with the purpose of reselling them at high prices to increase income and sales for the company. shop. Trusting Dung, Mr. Kien agreed to confirm the import.

In addition, Dung also asked Mr. Tran Van Quang (assistant manager of Mobile World store at 412 Hoang Hoa Tham, Hanoi) to create orders to request devices from other stores. Dung also gave false information as he told Mr. Kien and promised to pay in full immediately after receiving the goods.

From the beginning of April 2023 to April 23, 2023, Dung used the employee code to request orders to import phones from stores in the system to 21D Hang Bai store and asked Mr. Quang to take the phone to his warehouse. company here. After collecting the goods, Dung introduced to customers Mr. Tran Van S. (born in 1991, in Nam Tu Liem district) and Mr. Thai Van L. (born in 1995, in Tay Ho district) that the company has a code. Believing Dung, from April 19-23, 2023, Mr. S. and Mr. L. transferred a total of 3.7 billion VND to Dung's personal account to buy a phone.

After receiving the money, Dung continued to deceive Mr. Nguyen Van Kien that there were customers who ordered a large number of phones. Dung took advantage of loopholes in the "in-motion" goods management software to not record the phones on the ERP system, appropriated 139 phones and sold them to Mr. S. and Mr. L., without issuing invoices. Sales on the company system. The money received from two customers, Dung used for personal use and to play virtual money.

According to the asset valuation conclusion, 139 iPhone 14 Pro Max units have a total value of nearly 4 billion VND. Defendant Dung's family recovered 120 million VND. Mobile World Joint Stock Company asked Dung to compensate more than 3.8 billion VND for misappropriation.

According to the provisions of Clause 4, Article 174 of the 2015 Penal Code (amended and supplemented in 2017), if the offender appropriates property worth 500 million VND or more, he or she will be sentenced to 12 years in prison. up to 20 years or life imprisonment. With a total value of appropriated assets of nearly 4 billion VND, Nguyen Anh Dung could face a sentence of 12 to 20 years or life imprisonment. The specific sentence will be decided by the court based on the circumstances of the case and the level of the defendant's violation.
