Spot Pre-Market Terms

These Binance Spot Pre-Market Terms (these “Terms”) shall apply to your use of the Pre-Market Trading Functionality (as defined below). These Terms shall take effect as at the date that you first participate in Binance Pre-Market Trading Functionality.
These Terms are to be read together with, and shall supplement and form part of, the Binance spot trading terms (the “Spot Trading Terms”), the Binance launchpool terms (the “Launchpool Terms”), the Megadrop Terms (the “Megadrop Terms”) and the Binance terms of use (“Terms of Use”), as each may be amended, supplemented or replaced from time to time (collectively, the “Service Agreements”).
Capitalized terms used herein but not expressly defined shall have the meaning given to them in the Service Agreements, as the context requires. In the event of any conflict or inconsistency between these Terms and the terms of any Service Agreement, the provisions of these Terms shall prevail with respect to the services contemplated hereunder, unless expressly stated otherwise.
These Terms shall govern the provision of the Spot Pre-Market Trading Functionality (as defined below) to you and shall prevail over any previous versions of these Terms that may have been sent to you or otherwise made available on the Platform. By participating in Pre-Market Trading Functionality, you confirm your acceptance of these Terms and each of the Service Agreements as they relate to the services contemplated hereunder. You also acknowledge and confirm that you have read and understood the Risk Warning.
These Terms may be translated into a language other than the English language. Any such translation is provided solely for your convenience. In the event of inconsistency or ambiguity, the English text will prevail.
Spot Pre-Market Trading
a. The spot pre-market trading functionality allows you to engage in Pre-Market Trading on the Platform with respect to certain Pre-Market Tradable Assets during their respective Pre-Market Periods (the “Spot Pre-Market Trading Functionality”), subject to these Terms.
Pre-Market Restrictions
a. When you use the Pre-Market Trading Functionality, you will be subject to the following restrictions during the Pre-Market Period (collectively, the “Pre-Market Restrictions”), as set out below:
i. you will only be permitted to trade Pre-Market Tradable Assets with users who also have access to the Spot Pre-Market Trading Functionality and Orders in respect of the Pre-Market Tradable Asset can only be submitted from your master account;
ii. you will not be able to withdraw, transfer or deposit the Pre-Market Tradeable Asset from or to your Binance spot account during the Pre-Market Period;
iii. you will be subject to the Maximum Position Limit (i.e. you will not be able to purchase a Pre-Market Tradable Asset to the extent it would cause your aggregate holding in the relevant Pre-Market Tradeable Asset in your spot account to exceed the Maximum Position Limit).
b. Pre-Market Tradeable Assets will become Spot Tradeable Assets and will therefore cease being subject to the Pre-Market Restrictions at such time as they are listed for Spot Trading on the Exchange or such earlier time as Binance determines in its sole and absolute discretion.
c. Binance reserves the right, in its sole and absolute discretion, to disqualify trades of Pre-Market Tradable Assets, that it deems or suspects to be wash trades or related to batch registrations, as well as trades that display attributes of self-dealing, usage of shared devices or market manipulation.
d. Binance reserves the right, in its sole and absolute discretion, to disqualify users from participating in Pre-Market Trading, if it determines or suspects that users have, or attempted to, tamper with Binance program code, or interfere in any way with the operation of Binance program code with other software.
Launchpool Project Token Pre-Issue
Certain Launchpool Offers may be eligible for Pre-Marketing Trading as determined by Binance in its sole discretion. If a Launchpool Offer is eligible for Pre-Market Trading, this will be stated in the Launchpool Offer Terms and the Project Tokens generated during the Pre-Market Period will constitute Pre-Market Tradable Assets and will be subject to the Pre-Market Restrictions.
Megadrop Token Pre-Issue
Certain Megadrop projects may be eligible for Pre-Market Trading as determined by Binance in its sole discretion. If a Megadrop project is eligible for Pre-Market Trading, this will be stated in the Megadrop Announcement for the respective Megadrop project and the Megadrop project tokens generated during the Pre-Market Period will constitute Pre-Market Tradable Assets and will be subject to the Pre-Market Restrictions. Allocation of Megadrop project tokens to a user will be determined in accordance with the terms stated in the Megadrop announcement for the respective Megadrop project, prior to commencement of the respective Pre-Market Period.
Definitions
a. “Maximum Position Limit” means the maximum amount of a Pre-Market Tradable Asset that a user can hold, denominated with reference to the relevant Pre-Market Tradable Asset, and displayed on the Platform and as determined by Binance in its sole discretion.
b. “Pre-Market Period” means, in respect of a Pre-Market Tradeable Asset, the period commencing at the beginning of the Pre-Market Trading Period for such Pre-Market Tradeable Asset and ending at such time as the Pre-Market Tradeable Asset is listed for Spot Trading on the Exchange.
c. “Pre-Market Trading” means submitting buy or sell Orders via the Platform in respect of Pre-Market Tradable Assets.
d. “Pre-Market Trading Period” means, with respect to each Pre-Market Tradable Asset, the period commencing at the date and time stated in an announcement by Binance on the Platform that the corresponding Launchpool project or Megadrop project is available for Pre-Market Trading, and ending on or around the date and time stated in any subsequent announcement by Binance on the Platform that the Pre-Market Trading for the respective Launchpool project or Megdrop project is to end.
e. “Pre-Market Tradeable Asset” means any Supported Digital Assets that are subject to Pre-Market Restrictions, as determined by Binance in its sole discretion.
f. “Pre-Market Restrictions” has the meaning given to that term in clause 2 (Pre-Market Restrictions).
g. “Spot Pre-Market Trading Functionality” has the meaning given to that term in clause 1 (Spot Pre-Market Trading).
