The Coalition for Privacy Compliance in Advertising (CPCA) has embarked on a new venture in collaboration with the Information Commissioner’s Office (ICO). 

Together, they aim to develop the world’s first regulator-approved privacy certification tailored for digital advertising technology. This move is set to clarify the application of the UK General Data Protection Regulation (UK GDPR) in digital advertising, potentially reducing market uncertainty and bringing clarity to a sector that faces ongoing regulatory concerns. 

The initiative, announced on October 9, 2024, is being closely monitored as it progresses towards potential industry-wide impacts.

Addressing Privacy Concerns in Digital Advertising

The development of this privacy certification is seen as a key step toward resolving the ongoing confusion surrounding privacy compliance in digital advertising. Mattia Fosci, privacy lawyer and CEO of Anonymised founded CPCA in 2024 to address the growing concerns about how privacy regulations apply to the advertising industry. 

According to Fosci, there is still widespread uncertainty in the market. Complaints of privacy are being used as a shield for anti-competitive practices by large tech platforms, while smaller independent ad tech providers are offering products that may not fully comply with existing regulations. 

Fosci emphasized that creating this certification scheme will help apply UK GDPR requirements to advertising technology products, fostering a fair regulatory environment for all market participants, from startups to larger tech companies. 

This development aims to uphold privacy rights while giving businesses the regulatory guidance needed to operate confidently in digital advertising.

Support from Key Industry Bodies

The Incorporated Society of British Advertisers (ISBA) and the Association of Online Publishers (AOP) are set to join the CPCA governing board, reflecting a strong collaboration within the digital advertising industry.

The potential approval of this certification by the ICO represents a promising shift for publishers. Richard Reeves, managing director at AOP, highlighted how this development could clarify how UK GDPR applies to the industry. 

With a clear regulatory framework, publishers could be empowered to innovate confidently, knowing they stay within legal boundaries. Reeves expressed optimism that this certification could foster a more transparent marketplace, benefiting consumers and businesses. 

The participation of the Audit Bureau of Circulation (ABC UK), which will be responsible for auditing the certification, adds a layer of oversight and accountability. This is expected to enhance the certification’s credibility and ensure compliance with high industry standards.

If approved, the CPCA hopes to launch certification in 2025. Could be a pivotal standard for the UK and potentially beyond. Both European partners and the CPCA have already expressed their intentions to work together to create such certification schemes in the rest of the European Union.
