The legal proceedings began in February when Montenegro's High Court initially approved Kwon's extradition to the United States, where he faces charges related to the collapse of the Terra-Luna ecosystem in 2022. However, in March, the court reversed its decision, opting to extradite him to South Korea instead. This led to a series of appeals and conflicting verdicts, leaving Kwon's future uncertain. The extradition case has become a political issue in Montenegro, with accusations and alleged conflicts of interest emerging. Former Justice Minister Andrej Milovic accused Prime Minister Milojko Spajić of favoring extradition to South Korea due to alleged financial ties with Kwon.
Montenegrin media outlet Vijesti reported that Spajić, who became Prime Minister in October 2023, had invested $75,000 in 750,000 Terra LUNA tokens in April 2018. Spajić had previously denied any personal investment in the project until SEC documents revealed his involvement as an early investor in Terraform Labs. Do Kwon's defense attorney, Goran Rodić, stated to Montenegrin news outlet Pobjeda that Justice Minister Božović is legally obligated to base his extradition decision on established law and international agreements, emphasizing that the decision should not be political. Rodić argued that, based on legal grounds, Kwon should be extradited to South Korea rather than the United States.
