On September 26, 2024, U. S. Magistrate Judge Catherine Failla denied Storm's motion to dismiss the case and allowed it to proceed. Failla noted that the allegations against Storm were not baseless and that she cannot accept Mr. Storm's explanation that he is being prosecuted just for writing code.

Mr. Storm pleaded not guilty, claiming that Tornado Cache is open-source software that anyone can use and is not controlled by the developers of Tornado Cache.

If convicted of all three charges, Storm could face up to 45 years in prison. This event shocked the #cryptocurrency community and sparked support for software developers in trouble.

In June 2024, it was revealed that JusticeDAO was created to crowdsource the Tornado Cash Developer Protection Fund. The group has raised over 654 ETH and is valued at more than $1.5 million at current market prices.

Despite sanctions from the Office of Foreign Assets Control (OFAC) and legal pressure from U. S. authorities, deposits to Tornado Cash reached approximately $1.9 billion in the first half of 2024. This represents a 50% increase over the entire previous year.
