Ripple Files Opposition to SEC's Motion to Certify Interlocutory Appeal of XRP Ruling

Ripple Labs has opposed the U.S. Securities and Exchange Commission's (SEC) request for Judge Analisa Torres to certify an interlocutory appeal of her XRP ruling. Ripple argues that the necessary exceptional circumstances for such an appeal are absent. The crypto firm also asserts that the court should deny the SEC's request for a stay pending appeal. Ripple's legal team contends that the SEC's dissatisfaction with the court's application of Howey to XRP transactions is not a substantial ground for disagreement. Additionally, they highlight that the SEC acknowledges protracted litigation will continue even if the interlocutory appeal is granted, making certification unlikely to expedite the case's resolution. Meanwhile, the SEC recently lost another legal battle against a crypto firm regarding a proposed bitcoin exchange-traded fund (ETF) conversion by Grayscale Investments.
