According to Fortune, U.S. prosecutors disclosed in court documents filed on Monday some of the evidence they plan to use in the case against FTX founder Sam Bankman-Fried, including personal notes of his ex-girlfriend and Alameda Research CEO Caroline Ellison.

Prosecutors plan to use Ellison’s notes and to-do lists to prove that Bankman-Fried illegally used FTX customer funds to fill Alameda’s asset shortfall.

They also plan to use documents from two other co-conspirators who have cooperated with prosecutors. These include FTX’s former head of engineering Nishad Singh and co-founder Gary Wang.

Prosecutors also have an audio recording of Ellison at a Nov. 9 staff meeting in which she acknowledges that Alameda “borrowed” a large amount of funds from FTX.

Despite reports that another executive, Ryan Salame, is also seeking a plea deal, prosecutors have said he will invoke the Fifth Amendment to refuse to testify at trial.

Bankman-Fried's legal team objected to the delay in the prosecution's submission of evidence, saying it affected the preparation of the defense.
