The appeal is currently set for hearing in the federal court. Previously, Celsius accused FTX executives, employees, and affiliated companies of making defamatory statements that negatively impacted the company's reputation and financial health, allegedly accelerating the company's bankruptcy in July 2022. Celsius argued that FTX's public statements eroded public confidence in its services, forcing customers to withdraw funds and ultimately pushing the platform towards bankruptcy. According to court documents, Celsius initially claimed $2 billion based on 'unverified and disparaging statements' spread by FTX insiders. However, FTX rejected the claim, stating that Celsius's assertions lacked sufficient evidence and fell outside the scope of bankruptcy claims. In December last year, more than a year after initially filing the claim, Celsius amended its application, reducing the claim amount to $444 million. The revised claim shifted the focus to preferential transfers, alleging that certain payments made to it before FTX's bankruptcy should be recovered. However, Judge Dorsey dismissed both the original and amended claims on procedural grounds. The ruling emphasized that Celsius failed to seek court approval for the later amendments, ultimately upholding FTX's objections.
