The U.S. Court of Appeals for the Ninth Circuit has issued important dates related to the ongoing XRP lawsuit involving Ripple Labs and its CEO Brad Garlinghouse, a highly-watched case with an organized timeline for filing motions and responses. The court also issued guidelines on motions and filings required during the appeal process. According to the latest update, plaintiff Bradley Szostak must file a mediation questionnaire by December 23, with the order for the transcript of the appeal and the transcript of the appeal scheduled for filing on December 31 and January 30, respectively. The plaintiff is scheduled to file an opening brief on March 6, 2025, outlining the basis for the appeal against Ripple and its executives. Ripple will then file a response brief to the appeal by April 7, 2025. These deadlines pave the way for the appeal process, where both sides will present arguments before the Ninth Circuit Court and that the parties should assign or jointly assign the texts. Meanwhile, the SEC is preparing its lead brief in a separate case ahead of Chairman Gary Gensler’s scheduled departure on January 20, 2025. Gensler steps down just five days after the deadline.
