Chris Gober pointed out that the recipients were selected based on their "suitability" and personal stories. In response, the Philadelphia District Attorney's team said that this was Musk's "full admission of responsibility" and operating an illegal lottery in violation of Pennsylvania law. Gober argued that there is a difference between "random" and "accidental", which is why he claims that this is not an illegal lottery under Pennsylvania's gambling laws.
