PANews reported on October 13 that according to Fortune magazine, Elon Musk has little chance of winning his second lawsuit against OpenAI. It is reported that Musk is trying to force the organization he founded previously to pay him three times the $44.6 million he donated over five years and force it to open source all the research results behind its neural network GPT-4. Musk claims that there is a "founding agreement" reached with OpenAI CEO Sam Altman that explicitly prohibits this possibility. However, he failed to produce the agreement, arguing instead that it was fully reflected in the nonprofit's December 2015 registration certificate. Musk filed a second lawsuit in August, but OpenAI did not change its mind. OpenAI told Fortune magazine in a statement: "Musk's repeated complaints are groundless, and his previous emails remain self-explanatory."
