A federal judge in Utah criticized the SEC's handling of the case and said the agency acted in bad faith. The agency was ultimately ordered in March to pay a fine, including attorney fees and court costs. The same judge also criticized misleading statements from the SEC, which the agency acknowledged failed to meet expectations. "Does it make you a little embarrassed that we're talking about this today?" the Minnesota Republican asked. Gensler responded: "Things in that case were not handled very well."
