Terraform Labs co-founder Do Kwon will finally be extradited to South Korea after a legal process lasting more than a year in Montenegro.

The Court of Appeals upheld the High Court's decision in June to prioritize South Korea's extradition request over the US request. This priority is based on the order in which the request is submitted, with Korean requests being submitted first.

As a result, Kwon will be extradited to South Korea to face charges related to the collapse of his crypto projects, TerraUSD and LUNA, which collapsed in 2022 and caused huge financial losses. for investors globally.

Kwon was arrested in Montenegro in March 2023 while trying to travel to Dubai using fake travel documents. He was sentenced to four months in prison in Montenegro for passport forgery. Immediately after his arrest, both South Korea and the US submitted extradition requests.

In November 2023, the Podgorica High Court initially approved Kwon's extradition to South Korea or the United States, leaving the final decision to the Montenegrin Attorney General. However, Kwon's defense protested this decision, leading to a series of appeals and retrials.

In March, the Montenegrin Court of Appeals overturned the decision to extradite Kwon to the United States and directed a retrial to determine the appropriate extradition destination. Ultimately, the High Court ruled on Korea's request due to the order in which the request was filed.

Criminal charges

In addition to the extradition process, Do Kwon and Terraform Labs recently reached a tentative settlement with the U.S. Securities and Exchange Commission (SEC) regarding fraud allegations.

The deal follows a jury verdict in April, which found that Kwon and Terraform Labs defrauded investors by misrepresenting the stability of TerraUSD. The SEC announced in June that Kwon and Terraform Labs would pay more than $4.5 billion in fines.

Despite reaching an agreement with the SEC, Kwon still faces many serious legal challenges. The US Department of Justice has charged him with fraud in connection with the collapse of Terraform Labs, while South Korea has brought charges of fraud, bribery and market manipulation.
