It is very rare for the SEC to withdraw a case, usually based on legal technicalities or case strategy considerations. For example, the SEC recently withdrew some of its charges against the Binance exchange, specifically involving multiple tokens that were alleged to be unregistered securities. That's because the court expressed reservations about certain allegations, such as whether BUSD was an investment covenant, leading the SEC to tweak and refile parts of its lawsuit.
The case against Ripple currently appears less likely to be withdrawn. First of all, the lawsuit between the SEC and Ripple involves the core legal issue of "whether XRP is a security." The result may have a profound impact on the entire encryption industry. Secondly, the Ripple case has entered a critical stage of the judicial process, including the SEC’s appeal of part of the ruling, indicating that the SEC has no plans to withdraw the charges.
Therefore, although the SEC has a history of adjusting litigation strategies, in the Ripple case, it is unlikely that the SEC will withdraw and it is more likely to advance the case through appeals and continued arguments.
