A Texas court dismissed Consensys' lawsuit against the SEC and its chairman Gary Gensler on Thursday night. Consensys filed the lawsuit in April, accusing the SEC of investigating Ethereum and issuing a Wells notice to MetaMask. The court held that the SEC's enforcement action did not constitute a final institutional action and did not establish the plaintiff's legal rights or obligations.
At the same time, the allegations surrounding ETH were dismissed because the SEC had announced that it had stopped its investigation into ETH. Consensys said in a statement that although the court dismissed the lawsuit on procedural grounds, the SEC had granted Consensys the relief it sought on key issues in the Ethereum ecosystem.
