Before Hinman's speech in June 2018, the SEC regarded BTC and ETH as non-securities on the grounds of being 'sufficiently decentralized', while XRP was the second largest cryptocurrency by market value at that time. After the speech, ETH's market value surpassed XRP in November 2018.
The 'Hinman emails' found in the Ripple case show that there were differing opinions within the SEC regarding the content of the speech, with concerns about its impact on the regulatory status of other cryptocurrencies. Six years later, the regulatory status remains unclear.
