According to Foresight News, Haynes Boone partner Matthew Frankle said that as Gary Gensler is about to step down as SEC chairman, some of the cryptocurrency-related lawsuits initiated during his tenure may be withdrawn.
Frankle noted that these cases may be dropped if they do not involve substantial fraud and are legally permissible to dismiss. However, cryptocurrency will remain an important area of regulation for the SEC.
He predicted that the new SEC's regulatory approach may be more inclined to clarify the rules and provide compliance paths for industry participants, but the relevant changes may take time, and concrete results may only be seen after the new chairman takes office.
