Case Details: From November 2022 to February 2023, Fan profited by reselling the virtual currency “USDT.” During this period, the bank cards under his name used for receiving and cashing out transactions were frozen one after another. In March, Ping joined, and Fan lent 200,000 yuan as capital. From March to April 2023, in order to seek illegal profits, Ping and Fan, knowing that the trading funds for reselling “U” coins might be illegal gains, still helped criminals transfer funds through reselling “U” coins.
During this period, Fan was responsible for contacting buyers, sellers, and guarantors in the WeChat group and establishing group chats, providing “iTokenWallet” software accounts for buying and selling “U” coins, and driving Ping to various bank outlets in Tianjin for cash withdrawals and remittances.
Ping was responsible for communicating with buyers and sellers about trading accounts and specific amounts in the WeChat group established by Fan, providing his bank card for receiving money, cash withdrawals, and remittances to bank accounts designated by sellers, and looking for sellers on the “Douyin” app.
After driving Ping to various bank outlets for cash withdrawals, Ping would deduct 300 to 700 yuan in cash as profit and pay Fan a reward ranging from 100 to 300 yuan.
On April 8th, the bank card under Ping’s name used for transferring illegal gains was frozen by the public security agency due to suspected telecom fraud, leading to the case being uncovered. In summary, Ping and Fan helped criminals transfer funds amounting to 2,389,841 yuan, related to 7 telecom network fraud cases, involving defrauded funds of 148,650 yuan.
Among them, Ping illegally profited 2,600 yuan, and Fan illegally profited 1,600 yuan.
On the 3rd, the prosecution believed that the defendants Ping and Fan knowingly transferred criminal proceeds, the circumstances were serious, the facts of the crime were clear, and the evidence was indeed sufficient; they should be held criminally responsible for the crime of concealing and disguising criminal proceeds.
