ChainCatcher reported that according to Cryptoslate, a federal judge approved the court’s timetable for reviewing Consensys’ lawsuit against the U.S. Securities and Exchange Commission (SEC) and its commissioners. In a document filed with the U.S. District Court for the Northern District of Texas on July 1, Judge Reed O’Connor set a deadline requiring SEC and Consensys lawyers to submit opening statements and objection statements by September and November, respectively. In addition, the judge also granted the SEC a 28-day extension to respond to the complaint.

According to the timeline, all five SEC commissioners and regulators must file responses by July 29 and answer briefs by November 26. Bill Hughes, senior counsel and director of global regulatory affairs at Consensys, said in a July 2 social media post that he expects a ruling in the case to be made around December.

Consensys filed a lawsuit with the SEC in April, accusing the regulator of "illegal" attempts to control the "future of cryptocurrency" through enforcement actions aimed at regulating Ethereum as a security. In June of this year, Consensys reported that the SEC had ended its investigation into ETH. However, the SEC subsequently filed a lawsuit alleging that Consensys had been operating as an unregistered broker.
