The lawsuit, which has been ongoing for over a year, names O'Neal as a defendant, alleging that the NFT constitutes an unregistered security. Recently, Miami federal court judge Federico Moreno ruled on O'Neal's motion to dismiss, determining that the plaintiffs have sufficiently alleged that O'Neal was a 'seller' of the Astrals NFT project, requiring him to respond to these claims. However, the judge dismissed the assertion that O'Neal controlled the project. The lawsuit, filed in May 2023, claims that the NFT was an unregistered security promoted online by O'Neal. Judge Moreno stated that the lawsuit 'adequately alleges that Astrals and Galaxy tokens are 'securities' subject to federal securities laws.'
