What happened?
A group of investors tried to hold the platform liable for losses from “scam tokens” (rug pulls) issued by third parties. Since the real scammers could not be found, the plaintiffs decided to sue the protocol developers.
Why is this decision historic?
Judge Failla clearly distinguished between code and user actions:
• Decentralization is a reality: The court recognized that due to the nature of the protocol, token issuers are often unknown, but this does not give the right to automatically shift the blame to the infrastructure developers.
• Code logic: To quote the decision: “It defies logic to suggest that a smart contract developer should be liable for third-party abuse of the platform.”
• Lack of control: Uniswap is autonomous code, not a centralized intermediary. If a developer has no discretionary control over transactions, they are not liable for the harm caused by fraudsters.
