**Texas Judge Dismisses Consensys Lawsuit Against SEC**

A Texas federal judge has dismissed Consensys' lawsuit against the SEC and its commissioners, including Chair Gary Gensler. Filed in April, the suit sought to declare Ether (ETH) as not a security and to protect Consensys's ETH sales from being classified as securities transactions.

Judge Reed O’Connor ruled that the SEC’s enforcement actions, including a Wells notice regarding MetaMask, do not constitute final agency actions. He also noted that the SEC had already dropped its investigation into Ethereum by July, rendering Consensys' claims moot.
